Competition draws are operated by C A Goss ltd (referred to as the competition holder). ‘The competition holder’ runs exclusive ‘home improvement prize(s)’, competitions are shown on our website www.directwindowco.com, where ‘prizes’ will be allocated as a ‘prize’ to a ‘prize winner’ in accordance with the below terms and conditions below. The exclusive prizes are referred to as a ‘home improvement competition(s)’ or/and ‘competition(s)’ in the following terms & conditions.

 

  1. Choosing the competition correctly

 

  1. All home improvement prizes are to be determined by the director. All our prizes come with our standard warranty cover and will be scheduled in for installation alongside our current installations. Standard lead times apply.
  2. All home improvement prizes are as shown on the website and cannot be altered in colour, style or design.
  3. If a garden room, outdoor living space, conservatory or orangery is shown at a set size, this cannot be changed. If the size is shown at a set size, this cannot be increased in size to suit the property. We take no responsibility if the sizes will not fit at the rear, side or front of any property. If it is determined that the size requires reducing, there will be no cash alternative or reimbursements. The size will be installed to suit the required width or projection that we deem necessary to adhere to the terms and conditions of each competition. We would recommend measuring the area to determine and adequate fit, or the competition holder may decide to give the prize winner the cost price of the garden room, outdoor living space, conservatory or orangery as a cash alternative
  4. It is the responsibility of the homeowner to ensure that the competition prize they have entered to win is suitable for their house type/property.
  5. Planning permission will not be applied for on behalf of the prize winner. To be clear on current planning rules: 3m projection maximum on the rear of a semi-detached property (without planning) 4m projection maximum on the rear of a detached property (without planning). If the garden room, outdoor living space, conservatory or orangery is to be attaching to an extension this will require planning permission. If the garden room, outdoor living space, conservatory or orangery is to be situated on the side or front of the property this will require planning permission. Any prize winner that has not confirmed these planning rules before entering the competition may forfeit the prize or the competition holder may decide to give the prize winner the cost price of the garden room, outdoor living space, conservatory or orangery as a cash alternative.
  6. We will carry out a survey of the site after a prize has been won to determine the suitability of the area it is to be installed/situated.
  7. Placement of the garden room, outdoor living space, conservatory or orangery – If the garden room, outdoor living space, conservatory or orangery cannot be installed or built in the desired location due to extensive building work that exceeds the cost price of the building work included for the set style/size or design as shown on the website, the competition holder withholds the right to give the prize winner the total cost price of the garden room, outdoor living space, conservatory or orangery as a cash alternative.

Extensive building work not included: More than 3 courses of brick required below the damp proof course to reach solid ground. Piling or raft foundations. Gardens that slope away or towards the property requiring excavation. Manholes or drainage to be moved. Soil pipes to be moved. Structural work, RSJs required or steel calculations. Requires building regulations. If any these are required, the competition holder withholds the right to give the prize winner the total cost price of the garden room, outdoor living space, conservatory or orangery as a cash alternative.

  1. All garden room, outdoor living space, conservatory or orangeries include our standard finished packages as shown on the website. We do not install any type of flooring or skirting boards. We do not install plumbed in wet radiators.
  2. Installation will be at a home address in the United Kingdom only. the competition holder withholds the right to give the prize winner the total cost price of the prize if they do not live within the required proximity of the companies registered address. Due to the logistics of our installations, the proximity required is within a 60-mile radius of the companies registered address.
  3. The prize winner is responsible for all taxes, duties or charges in relation to receipt of the prize.
  4. A contract may be required to be signed by the prize winner before the work can commence, to confirm acceptance of the overall design, style and size of the prize. The prize winner hereby agrees that all prizes are subject to and are conditional on the terms and conditions of the competition holder, prize provider, manufacturer and/or supplier and/or anyone that is involved in the provision of installing the prize.
  5. Each prize awarded to the prize winner is non-transferable or convertible to other means and cannot be used in conjunction with any outstanding debts owed to C A Goss ltd, vouchers, offers or discounts, including without limitation any vouchers or offers of the competition holder or other prize suppliers and/or third parties.
  6. Prize winners have the option to elect to receive either the total cost price of the prize for the competition or a cash alternative set by the competition holder which is reasonably equivalent to the cost of the prize.

 

  1. Home improvement prizes

 

  1. A competition will commence from the time each competition was launched on our website, the competition finishes when the clock stops. no competition will have time extensions. We withhold the right to finish a competition early and at our own discretion.
  2. Multiple competitions may be run at the same time by C A Goss ltd, each competition will have a specific home improvement prize.
  3. The availability and cost of our competitions is at the discretion of C A Goss ltd and will be advertised on the website or in our Direct times Newspaper. All our competitions have a free entry route, as well as a paid entry route. The free entry route for our competitions means that the competition does not fall within the definition of a ‘lottery’ under the Gambling Act 2005. This means any competition we may promote or run, can be operated legally in the United Kingdom without any requirement for licensing.
  4. Our competitions will be operated until the time shown on the website. Our website will show the start and end times including dates for the period a competition is run.

 

  1. Choosing a winner

 

  1. Each competition will have a minimum and a maximum number of entries.
  2. If the minimum number of entries is not achieved before the competition ends, a winner will be randomly chosen and will receive a cash alternative (shown as ‘secondary prize’) equal to 50% of the value of ticket sales for the competition entered.
  3. If the maximum number of entries is achieved before the competition ends, the competition holder may bring the draw date forward. if the competition holder closes a competition early, the prize winner will be selected from all valid and eligible entries received by the competition holder prior to the date of closure.
  4. C A Goss ltd use an independent online system to randomly determine the winner of each home improvement competition’s prize. The result will be uploaded to our website and the winner will be shown in our newspaper.
  5. There will only be one main winner per competition unless the competition holder states otherwise on the website.
  6. If we are unable to contact a winner within seven days of the competition finishing, or the winner fails to confirm acceptance of the prize and/or the winner is disqualified as a result of not complying with or contravening any of these terms and conditions, the winner hereby agrees that it will immediately, irrevocably and automatically forfeit the prize and the prize will remain in the possession and ownership of C A Goss ltd..
  7. C A Goss ltd will attempt to contact the competition winner using the contact details provided by the entry. Participants of our competitions must carefully check their contact details have been entered correctly. The responsibility to confirm contact details are correct is solely the participants. C A Goss ltd will not be held responsible for any contact details entered incorrectly.
  8. Entrants who specifically consent to marketing communications will be entered onto our database for the purpose of conveying information as to the status of their competition, as well as any future promotions or competitions offered by C A Goss ltd.
  9. Our independent system will randomly select a winner for each competition at the end of the competition as shown on our website. There will be no extensions to the competition period.
  10. C A Goss ltd reserves the right to cancel any competition at any time either before or after entries have been sold. If a competition is cancelled, the competition holder will notify each entrant at the email address they have provided and return any payment made by an entrant by the same method of payment, where a payment has been refunded, the competition holder will have no further liability to the entrant or to any other person.

 

  1. Eligibility for competitions

 

  1. No more than one home improvement prize can be awarded to any competition winner. If the same entrant wins on multiple occasions, the competition holder withholds the right to offer a cash alternative equal to the cost price of the prize.
  2. Any home improvement competitions are authorised to be entered by anyone aged 18. we only allow entries to be within the United Kingdom. any entry outside of this area will be forfeited.
  3. Any staff or employees working for C A Goss ltd, or any person connected with C A Goss limited (family or professional) are not permitted to participate in our home improvement competitions.
  4. When entering our home improvement competitions, the entrant: must have read, understood and accepted all terms and conditions set out, understands they are bound by all terms and conditions, and by any other related promotional material on our website, be a legal person to enter it, (age, country, legal payment). by participating in a competition either online via the website or by postal entry, you hereby confirm that you are not breaching any laws in the United Kingdom, regarding the legality of entering our competitions. C A Goss ltd will not be held responsible for unlawful competition entries. C A Goss ltd reserve the right to refuse an entry at our own discretion if it does not fall within our terms and conditions. any matters or disputes relating to the competition will be dealt with and/or resolved under UK law and jurisdiction.
  5. Online or postal competition entries will be accepted if they arrive before the competition finishes. competition entries will be given a random number/s. all entries received by post will be treated in the exact same way as paid online entries. if all tickets have been sold for a competition, no further entries will be accepted when competition has closed.
  6. Online entry and/or a postal entry, you will not be deemed entered the competition until we confirm your entry which can be confirmed in your account when you login or we may send you an email confirming it.
  7. C A Goss reserves the right to refuse an entry or disqualify any incomplete entry, if it has reasonable grounds for believing that an entrant has contravened any of these terms and conditions.
  8. C A Goss reserves the right to disqualify an entry if it has reasonable grounds for believing that an entrant’s conduct might be contrary to the spirit or intention of the competition, including conduct that might be abusive or racist or where an entrant has posted, or is likely to post, defamatory comments on the website, review websites or social media.
  9. All entries are final, and no refunds will be made at any time, except for refunds made in line with our terms and conditions. To the extent permitted by applicable law, all entries become the competition holder’s property and will not be returned.
  10. Postal entries will be processed daily. If a competition has sold out, the website will state that it has sold out and then no further entries will be accepted.
  11. An entrant can enter each competition up to the maximum number of times stated on each competition’s page on the website, however, only one free postal entry per competition is allowed per person.
  12. Each competition will stipulate the minimum number of entries and the maximum number of entries. Each competition closes when the last number is taken, or the competition timer runs out, no more entries after this point will be accepted.

 

  1. Winner confirmation

 

  1. Any winner will need to provide documentary for proof of their age (18+) and identification prior to the receipt of a prize. any failure to meet this requirement may result in the winner being disqualified and the competition holder re-allocating the prize.
  2. All winners are required to provide photographs of videos of them receiving the notification they have won a prize, and have their personal details (including details of any prize won by them) included in marketing material and public relations by the competition holder in connection with the competition and in identifying them as a prize winner of a competition. Any failure to meet this requirement may result in the winner being disqualified and the competition holder re-allocating the prize.
  3. Following receipt and verification of the details requested above by the competition holder and provided that the prize winner has satisfied these terms and conditions, the prize winners will be contacted to arrange for the products to be installed.

 

  1. Time frame

 

  1. C A Goss ltd will install/deliver the product within an agreed period. Prizes can be held for up to 60 days. At the end of which time the prize will be installed at the prize winner’s property. If we are not authorised to install the prize by the prize winner before the 60 days finishes (date commences from when the prize was won), the competition holder may decide to give the prize winner the cost price as a cash alternative.

 

  1. Winners’ Personal Data
  2. a. Subject to the winner’s consent, the winner may be asked to have their photo and video taken by the competition holder for use on the website, newspaper, social media or general marketing material.

 

  1. Data Protection Notice
  1. C A Goss ltd need to collect some personal data. Personal data includes, Titles, Names, addresses, phone numbers and email addresses, and where applicable the details required to complete a finance application or validate a card payment. Any prize winner’s information will be retained for as long as there is a product guarantee in place, this shall not exceed 10 years. We process and retain the information for the following reasons: To register your prize with F.E.N.S.A – This is a requirement of the Competent Person Scheme for self-certification under building regulations. We only register with F.E.N.S.A once goods are installed. To register your insurance-backed guarantee with Q.A.N.W. – Quality Assured National Warranty – this is only applicable once goods are installed. To hold contact details so we can efficiently locate your order and answer your queries should you need post-installation or after-sales service. Your data will not be shared with any third parties other than those highlighted above. Should you wish to remove consent, make any corrections, erase your data, restrict who your data is shared with or lodge a complaint with a supervisor please email Matthew Lynton using the following link, [email protected]. Please be aware that we may not be able to erase some or all personal if the prize winner is contractually obliged to allow us to retain it. Personal data is used to provide you with essential documentation and will be retained on files for the lifetime of the guarantees which does not exceed 10 years.

Limits of Liability

 

  1. C A Goss ltd makes or gives no representations and/or warranties and/or assurances of whatever nature and howsoever arising (and whether in writing or otherwise) as to the quality, suitability and/or fitness for any particular purpose of any of the goods or services advertised, offered and/or provided as prizes. except for liability for death or personal injury caused by the negligence of the competition holder and/or for any fraudulent misrepresentations and/or for any events and/or circumstances to the extent that they cannot be excluded or limited by law. The competition holder shall not be liable for any financial loss suffered from days of work or sustained to person or property including, but not limited to, consequential (including economic) loss by reason of any act or omission by the competition holder, or its employees or contractors in connection with the arrangement for supply, or the supply, of any goods by any person to the prize winner(s) and, where applicable, to any family/persons accompanying the prize winner(s), or in connection with any of the competitions. The total maximum liability of the competition holder to each prize winner shall be limited to the total cost value of each prize that has been won by the relevant prize winner. The total maximum liability of the competition holder to you as an entrant shall (if you are not a prize winner) be limited to the amount that you have paid to enter competitions in the first 12 months of you playing any competition.

 

  1. Online or software

 

  1. C A Goss shall use its reasonable endeavours to award the prize for a competition to the correct entrant. if due to reasons of hardware, software or other computer related failure, or due to human error, the prize is awarded incorrectly, the competition holder reserves the right to reclaim the prize and award it to the correct entrant, at its sole discretion and without admission of liability and the entrant that has been incorrectly awarded the prize will immediately at the entrant’s own cost and expense return it to the competition holder and/or pay the competition holder for that prize (at the option of the competition holder). the competition holder shall not be liable for any economic and/or other loss and/or consequential loss suffered or sustained to any persons to whom an award has been incorrectly made, and no compensation shall be due to such persons. the competition holder shall use its reasonable endeavours to ensure that the software and website(s) used to operate its competitions performs correctly and accurately across the latest versions of popular internet, tablet and mobile browsers. for the avoidance of doubt, only the ticket recorded in our systems, howsoever displayed or calculated, shall be entered into the relevant competition and the competition holder shall not be held liable for any competition entries that occur because of malfunctioning software or other event.

 

 

  1. Validation

 

  1. The competition holder hereby reserves the right not to install a prize to until it is satisfied that: the prize winner has a validly registered website account and/or is not in breach of these terms and conditions; any and/or all amounts due or owing by you to the competition holder have been paid in full. The age and identity of the prize winner and his or her entitlement to receive the prize has been established to the competition holder satisfaction (in particular, the competition holder reserves the right to request documentary proof of age and identity and not to give or make a prize until satisfied appropriate proof of age and identity have been provided).
  2. The competition holder reserves the right to not manufacture or install a prize and/or to retrieve a prize or the value of the prize, in each case if it reasonably suspects the occurrence of fraud in relation to a competition.
  3. The competition holder may, in its absolute and sole discretion, give or make a prize to a person whom it is satisfied is the duly authorised representative of the prize winner acting under a lawfully executed power of attorney or other equivalent authorisation.

 

  1. Using your account

 

  1. You must always keep your account password secure and secret and take steps to prevent it being used without your permission. you must: memorise your password and never tell it to anyone, never write your password down (including on your computer or other electronic device) or record it in a way that can be understood by someone else, destroy any communications from the competition holder in relation to your password as soon as you have read them, avoid using a password that is easy to guess, ensure that no-one else (apart from you) uses your account while you and/or your devices are logged on to the website (including by logging on to your devices through a mobile, wi-fi or shared access connection they are using), log off or exit from your account when not using it, and keep your password or other access information secret,
  2. Your password and log in details are personal to you and should not be given to anyone else and/or used to provide shared access e.g. over a network. You must use a password which is unique to your account and maintain good internet security.
  3. You must contact the competition holder immediately if you believe, suspect or know that anyone apart from you has used your account and/or given any instruction in relation to it without your permission, or if you believe, suspect or know someone else knows your password.
  4. If you forget your password, you can reset it by following the instructions on the website (if you can provide the relevant security information requested or required by the competition holder).
  5. The competition holder shall not be responsible and/or liable for any and/or all consequences arising out of and/or relating to any and/or all breaches of this rule by you. furthermore, the competition holder shall not in any event be responsible and/or liable for any actions and/or inactions that you may take and/or consequences that you may suffer and/or incur because of using and/or in connection with the website.

 

  1. Unauthorised card or credit card payments

 

  1. If you notify your nominated bank (or building society) that your debit card has been used without your permission in relation to a competition, and your nominated bank (or building society) asks the competition holder to return the relevant amount to your nominated bank (or building society) account, the competition holder may suspend your account and ask you to contact C A Goss ltd. The competition holder accepts no responsibility and will have no liability for any chargebacks.

 

  1. Payments

 

  1. Cash alternatives will be bank transferred only; no physical cash is given.
  2. All transfers will be to the sole name of the prize winner, no family members or friends.
  3. If you dispute any payment made to or by C A Goss ltd, you shall contact us immediately to discuss repayment or other means of payment.

 

 

  1. Entering a competition

 

  1. When entering your first home improvement competition, we require a new registered account being created on our website. Once registered, you can submit your entry on our website, or a postal entry as set out it in these terms and conditions. If you would like to take part, entries must be received before the competition has completed. Completion will finish at a time shown on the website. Participants that want to take part in a competition, must confirm they have read and accepted these terms and conditions.
  2. All participants must provide their contact details to C A Goss ltd, including full name, date of birth, email address, postal address, contact telephone number. By entering your contact details correctly, winners will have their names and town/city shown on our website or newspaper as a winner unless the winner decides this is not accepted.

 

  1. Online Entries

 

  1. Online competitions being played must be played using the method shown on our website. Choose the competition you want to enter, purchase your ticket(s) to the competition. Provide your contact and payment details. You will need to confirm your details are correct via our declaration, confirming you have read and understood the competition terms and conditions. On entry to our competition, we contact you by email to confirm your entry.

 

  1. By post

 

  1. If playing by post, entrants must specify the home improvement competition to take part in, providing contact details to C A Goss ltd by post using the address: ‘Direct home improvement competition entry’ Units 41-42 Arkwright Court, Blackpool & Fylde Industrial Estate, Blackpool, Lancashire, FY4 5DR. 1st or 2nd class postage must be paid by the person entering at their own cost. More than one entry in the same envelope will not be accepted. You are limited to one entry per postcard, bulk entries will not be accepted. Each entry needs to be in a separate envelop. Competition entries with no stamp, hand delivered or posted directly into our letterbox will not be accepted. One postal entry permitted per home improvement competition for each registered account. You must create an account before you post your free postal entry. Any home improvement competition entered by post has the same chance of winning as an online entry. All postal entries must be received a minimum of 24 hours before the competition finishes.

 

  1. Terms and conditions overall

 

  1. A person who does not agree to these terms and conditions has no rights under the contracts (Rights of Third Parties) Act 1999 (as amended or re-enacted from time to time, and any subordinate legislation made under that act) or otherwise to enforce any provision of these terms and conditions.
  2. You may not assign or otherwise transfer (in whole or in part) your rights and/or obligations under these terms and conditions. Any breach of this clause may result in the use of your account and/or the provision of the competition and/or access to the website being suspended or terminated immediately by the competition holder. The competition holder may assign or otherwise their rights and/or obligations under these terms and conditions in whole or in part to any third party at its sole and absolute discretion and without your consent.
  3. If any provision (or part of a provision) of these terms and conditions is decided by a court of competent jurisdiction to be void and/or unenforceable, that decision will only affect the particular provision (or part of the provision) and will not make the other provisions void or unenforceable.
  4. These terms and conditions constitute the entire agreement between you and the competition holder regarding the subject matter of these terms conditions and supersede and replace any other prior and/or contemporaneous agreements, and/or terms and conditions applicable to the subject matter of these terms and conditions.
  5. The competition holder will not be liable for any delay or failure to perform any obligation under these terms and conditions where the delay or failure results from any cause beyond its reasonable control, including acts of God, labour disputes or other industrial disturbances, electrical or power outages, utilities or other telecommunication/network failures, earthquake, storms, or other elements of nature, blockages, embargoes, riots, acts or orders of government, acts of terrorism, or war.
  6. If the competition holder fails and/or delays to enforce a provision of the terms and conditions, this failure and/or delay is not a waiver of the competition holders right to do so later.
